Application of the T&Cs

These general terms and conditions of sale apply, without restriction or reservation, to all reservations for accommodation and temporary pitches made at the La Nouvelle Croze campsite, operated by SARL LNC CAMPING, by its customers.

In accordance with the provisions of Article L.113-3 of the Consumer Code and the provisions of the Tourism Code, these general terms and conditions are made available and communicated to any customer who is required, prior to the conclusion of any reservation, to read them under their sole responsibility. Validation of the accommodation reservation by the customer constitutes acceptance without restriction or reservation of these general terms and conditions of sale. These general terms and conditions of sale may be subject to subsequent modifications, the applicable version is that of the day the reservation contract is concluded.

The contact details of the service provider are as follows: SARL LNC CAMPING, a limited liability company with capital of 10,000 Euros, registered with the RCS PÉRIGUEUX under the unique identification number 834.868.325, located in ROUFFIGNAC SAINT CERNIN (24580), and taken in the person of its current Manager.

Reservation

The customer reserves a pitch located in the campsite or accommodation offered according to the following terms: either via the La Nouvelle Croze campsite website accessible at the address www.lanouvellecroze.com; either by telephone call confirmed in writing (email or postal delivery) within 24 hours/days of receipt of the telephone call.

It is the customer’s responsibility to check the accuracy of the reservation and to immediately report any errors to the La Nouvelle Croze campsite.

The reservation of the pitch or accommodation will only be considered final after the customer has been sent confirmation of acceptance of the reservation by the La Nouvelle Croze campsite and after the latter has received the full deposit due and any administration fees; whether or not it is for a distance sale requiring the establishment of a prior personalized quote.

The accommodations (mobile homes) are only rented for the week, obligatorily over the calendar period from Saturday to the following Saturday, during the months of July and August. The pitches are rented out per night.

SARL LNC CAMPING reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

Any other reservation made via intermediaries will not be governed by these terms and conditions.

Withdrawal

The legal provisions relating to the right of withdrawal in the event of distance selling provided for by the Consumer Code do not apply to accommodation services, in accordance with Article L.221-28 of the Consumer Code.

Prices

The accommodation and pitches offered by the La Nouvelle Croze campsite are provided at the current rates displayed at the campsite headquarters, on its website lanouvellecroze.com or according to the quote drawn up by the service provider. These rates may be subject to variation during the season. The stay will be billed at the rate in effect at the time of booking.

Rates are inclusive of all taxes. The contractual price may be modified within the legal and regulatory limits, when there are variations in the applicable VAT rates, between the booking date and the balance payment date.

However, the mandatory tourist tax is not included in the price of the stay and must be paid by the customer once on site. This tax is set by local authorities and is entirely paid to the tourist office.

An eco-responsible contribution is set up for our stays, in order to carry out various awareness-raising and environmentally friendly projects. This contribution amounts to €0.25 per person.

Options are charged in addition, under the same conditions as the basic rates.

A processing fee of €18 is charged, applicable to each reservation, except in the case of a temporary commercial operation in progress at the time of booking.

Payment conditions

Payment of the deposit

The reservation will only be final after receipt of the deposit. For reservations of accommodation or pitches, the deposit corresponds to an amount of 25% of the total stay (excluding processing fees and cancellation option). In the event of a special online operation less than a month before arrival, the full payment may be required, i.e. a deposit of 100%.

Payment of the balance

The price of the balance of the stay must be paid upon the customer’s arrival at the La Nouvelle Croze campsite, at the start of their stay.

In the event of non-compliance with the payment conditions and in particular the payment of the balance of the stay, SARL LNC CAMPING reserves the right to suspend or cancel the provision of accommodation services or the provision of a pitch reserved by the customer and/or to suspend the execution of its own obligations. In this case, the La Nouvelle Croze campsite may collect compensation under the same conditions provided for in the article “cancellation of the reservation at the initiative of the customer”.

Payment of a deposit

At the start of the customer’s stay, upon arrival, a deposit of 200 Euros by bank imprint will be required with the customer’s signed authorization. In addition, a deposit of 90 Euros, in application of the “cleaning package” will also be required.

Deposits will be returned at the end of the stay after an inventory of fixtures at the end of the stay.

Refusal to grant a deposit under the aforementioned conditions may result in the suspension or cancellation of the provision of accommodation services or the provision of a location reserved by the customer, without any possible compensation for the customer. In this case, the La Nouvelle Croze campsite may receive compensation under the same conditions set out in the article “cancellation of the reservation at the initiative of the customer”.

Methods of payment

Payment of the deposit when booking the stay is possible by credit card, bank transfer or bank check payable to “Camping La Nouvelle Croze”.

Payment of the balance of the stay may be made in cash, bank check, bank card or holiday vouchers (ANCV).

In the event of payment by bank check, it must be issued by a bank domiciled in mainland France or Monaco. The check will be cashed upon receipt.

Cancellation of the reservation at the customer’s initiative

Any cancellation of a reservation at the customer’s initiative must be made by email or post as soon as possible to the La Nouvelle Croze campsite.

Depending on the time period within which the cancellation at the customer’s initiative is made, it will result in disorganization of the La Nouvelle Croze campsite, the management of its reservation book and an impossibility, more or less significant, to market the accommodation or the location that would be the subject of the cancellation.

Compensation will be collected by SARL LNC CAMPING which agrees to a limitation of the customer’s liability due to its cancellation, under the following conditions:

• More than 30 days before the start date of the stay: the deposit will be retained by the La Nouvelle Croze campsite as a fixed compensation, but the amount of this deposit may be deducted from a reservation made within one (1) year of said cancellation.
• Between 29 and 21 days before the start date of the stay: the deposit will be retained by the La Nouvelle Croze campsite as compensation, in addition to a fixed compensation corresponding to 60% of the price of the stay excluding VAT.
• Between 20 and 7 days before the start date of the stay: the deposit will be retained by the La Nouvelle Croze campsite as compensation, in addition to a fixed compensation corresponding to 80% of the price of the stay excluding VAT;
• Less than 7 days from the start date of the stay: the deposit will be retained by the campsite La Nouvelle Croze as compensation, in addition to a fixed compensation corresponding to the full price of the stay excluding VAT.

Any stay interrupted or shortened (late arrival, early departure) due to the customer will not give rise to a refund.

In the event of an event beyond the control of the establishment, which could not reasonably have been foreseen when the contract was concluded, the sums paid will not give rise to a refund. The postponement of the stay under conditions or any other measure imposed by the public authorities will be proposed.

SARL LNC CAMPING agrees to waive these fixed, limited and contractual compensations, under conditions only for all customers who have subscribed to the “cancellation option” offered by the La Nouvelle Croze campsite.

Cancellation option

The cancellation option is an optional contractual option and accessory to the accommodation or pitch reservation contract.

Its subscription by the customer and the fulfillment of one of the conditions of its implementation will entail the waiver by the La Nouvelle Croze campsite of the compensation that it is entitled to obtain to repair the damage resulting from the cancellation of the reservation by the customer.

Subscription to the cancellation option must be concomitant with the reservation of the accommodation or the pitch. The marketing of this offer to the customer ceases after confirmation of their reservation under the conditions provided for in the article “reservation”.

This option is offered at the flat rate of 34 Euros per week reserved for accommodation and 14 Euros per week reserved for bare pitches.

In addition to the correct collection of the price of the service, SARL LNC CAMPING will only waive its compensation in the event of the occurrence of one of the following events, listed exhaustively, which could prevent the arrival of the customer at the campsite:

• Medical event: serious illness, accident or death of the customer, their spouse, children or parents.
  The medical event must occur between the reservation and the start of the stay.
• Event professional: cancellation or modification of the dates of paid leave of the client or his spouse by the employer and affecting the period of the stay; redundancy of the client or his spouse; transfer of the client or his spouse which would prevent the presence on the premises of the campsite for the reserved dates.
  The professional event must occur between the reservation and the start of the stay.
• Material event: disaster of a serious nature affecting the client’s main residence (fire, explosion, water damage, theft or natural disaster); serious incident affecting the vehicle and resulting in its immobilization.
  The material event must occur at the latest 48 hours before the start of the stay.

The cancellation option cannot come into effect when the event that occurs was known on the day of the reservation and subscription to this option.

To implement this option, the customer must send by email or post any element justifying the occurrence of one of the aforementioned events.

The application of the cancellation option results in the waiver by SARL LNC CAMPING of the compensation strictly and exhaustively provided for in the article “cancellation of the reservation at the initiative of the customer” and does not in any case concern the restitution of the sums relating to the administration fees and the subscription to this “cancellation option” which remain acquired by the campsite La Nouvelle Croze.

The possible restitution of sums received, and which would have is the subject of a contractual novation to become compensation, is carried out by the La Nouvelle Croze campsite within 14 working days from receipt of the required supporting documents, provided that they are deemed sufficiently convincing by the campsite.

Arrival and departure of customers

The allocation of a pitch or accommodation will be made on the day of the customer’s arrival, in the best possible respect of their expectations, as this is only an obligation of means.

Regarding accommodation (mobile homes), arrival must be from 3 p.m. and departure before 10 a.m. For bare pitches, arrival must be from 12 noon and departure must be no later than 12 noon on the scheduled day.

The customer has a contractual obligation to notify the La Nouvelle Croze campsite of their delay in arrival and outside reception hours, by any means at their convenience.

Beyond a delay of 24 hours from the arrival time specified in the reservation contract, and without the customer having previously notified the La Nouvelle Croze campsite, the latter reserves the right to no longer accept the customer and no refund will be made by the La Nouvelle Croze campsite, which will retain any sum already collected as compensation and may demand the payment of a fixed compensation under the same conditions provided for in the article “cancellation of the reservation at the initiative of the customer”.

In addition, no refund will be made in proportion to the time during which the accommodation or location would not be used by the customer.

In the event of early departure of the customer compared to the dates and times provided for in the reservation contract, no refund will be made.

In this case, the cancellation option is not applicable and is completely excluded.

Transfer of the reservation

In accordance with articles L.211-11 and R.211-7 of the Tourism Code, the customer may transfer his contract to a third party, subject to informing the La Nouvelle Croze campsite, at the latest 7 days before the start of the stay, indicating the name and address of the transferee. The transferee will be deemed to have read the general terms and conditions of sale.

Internal regulations

The customer must comply with the internal regulations of the La Nouvelle Croze campsite, which he may read at any time and at the latest, upon arrival on the premises.

Various services

Animals are allowed on the campsite grounds provided that they are on a lead, tattooed and vaccinated. Animals are subject to a tax of 6.50 Euros per night for accommodation and 2.00 Euros for pitches.

The cleaning package offered to the customer does not correspond to a full cleaning of the accommodation, so a partial cleaning must be carried out by the customer before departure.

Possible visitors invited by their camper hosts are authorized to access all of the campsite’s services, after paying the “visitor fee” set at the daily price of 7.00 Euros.

Protection of personal data

SARL LNC CAMPING considers any information that allows the customer and their stay at the La Nouvelle Croze campsite to be personal data.

The collection of this information, during the reservation of the accommodation or pitch, is essential to the execution of the campsite’s obligation. Refusal to consent to the processing of personal data would prevent the execution of the service.

SARL LNC CAMPING which collects the information is responsible for its processing and undertakes to ensure the technical protection and confidentiality of the data.

SARL LNC CAMPING does not transmit any personal information or any contractual information, in any way whatsoever, to third parties.

In accordance with EU Regulation 2016/679 (GDPR), the customer has the right to access, modify, rectify and delete data concerning him, by contacting the La Nouvelle Croze campsite by email: contact@lanouvellecroze.com

Any complaint must be filed by the customer with the CNIL.

Applicable law – Disputes

These general terms and conditions of sale and the operations resulting from them between SARL LNC CAMPING and the customer are governed by and subject to French law. These general terms and conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be authentic in the event of a dispute.

Any dispute relating to their interpretation and execution shall be submitted to the competent Courts under the conditions of common law. However, in the event that a reservation is made by a trader, the dispute will be brought before the Commercial Court of PÉRIGUEUX in accordance with Article 48 of the Code of Civil Procedure.

The customer is informed, in accordance with Article L.211-3 of the Consumer Code, that he may in any event resort to conventional mediation, in particular with the Consumer Mediation Commission or with existing sectoral mediation bodies, or to any alternative dispute resolution method.

Customer acceptance

The customer acknowledges having received, prior to any reservation, in a clear and comprehensible manner, these general terms and conditions of sale and all the information listed in Article L.221-5 of the Consumer Code.

The fact that any person makes a reservation implies full adherence and acceptance of these general terms and conditions of sale and obligation to pay for the services, which is expressly acknowledged by the customer who waives the right to rely on any contradictory document which would be unenforceable against the La Nouvelle Croze campsite.
